The case was brought up by Marvel Comics subsidiary Toy Biz(the company producing X-Men toys) before the U. S. court of International Trade. But a verdict favoring anti-mutants recorded by the U. S. federal court says that the super hero team (Cyclops, Iceman, Angel, Beast, and Marvel Girl) are far from humans.
In brief: The legal issue involving Marvel Enterprises Inc. and U. S. customs service was settled by the verdict of Judge Judith Barzilay. The case had few earlier decisions in the year 2000, 2001, and 2002. In favor of Toy Biz, verdict was given on 3rd January 2003. The case finally eliminated distinction between doll and toy. Even though the decision dint sits well with fans, the last smile was with Toy Biz.
The creation of Stan Lee and artist Jack Kirby which hit the screens at early 1960's is now under pressure in part of their trading. The toy line of X-men when imported do not count as humans, as per the U.S. federal court verdict. This decision went on pending for a decade, after Toy Biz, filed the case during their import from China. Toy Biz argued that their superheroes are humans with extraordinary powers, they breathe like humans, but with nonhuman powers. This was against the protest of fans too. But as far as trade is concerned, these superhero toys were charged more than the usual tariffs since it weren’t counted under doll category. Dolls (represented only a human being) were taxed 12% on import while
toys (basically anything that isn't only representing a human) 6.8%. Even though the court gave the universal answer for the case, it can never clear the doubt whether super hero like Spiderman, Batman, which contain the name "man" in it just like X-men, come under doll or toy. And, during the rule declared on 2002 Silver Samurai was adjudged as doll. This in near future could have made a court issue, at least in the case of Silver Samurai which is so similar to X-men.
And finally, the case brought down the tariff rates of both doll and toy and eliminated the difference between them. During early months of 2003, to be precise January 3, court ruled favoring Toy Biz, granting compensation for imported taxes on previous toys. This decision was made by Judge Judith Barzilay after a keen examination of 60 plus toys. The question from fans remains, whether these superheroes are creatures? By the by, these superhero protects humans and humans are least
bothered of their upcoming issues.
