The trial court system of Oklahoma State consists of Court of Tax Review, Workers Compensation Court of Existing Claims, Municipal Courts, and District Courts.
Oklahoma District Courts have general jurisdiction to handle all types of cases, but generally handle only the cases that other courts have no jurisdiction over.
District Courts have Small Claims departments for handling most general civil cases with up to $10,000 in dispute, exclusive of costs and attorney fees. Types of cases include interpleader, the return of money or personal property, and suits that seek money damages based on a tort or contract.
A District Court may have a specialized program or division for certain types of cases, including Mental Health Court, Drug Court, and Business Court. Business Courts may exist in counties with huge populations to hear complex commercial cases. A District Court may have a Mental Health Court, Drug Court, and Juvenile Drug Court program for handling certain non-violent cases in which the offender has some treatable addiction or condition.
Oklahoma Municipal Courts have limited jurisdiction over most criminal as well as traffic cases involving violations of municipal ordinances. Besides, some Municipal Courts can also hear misdemeanor criminal cases.
There are some Municipal Courts with a Mental Health Court division for handling certain non-violent criminal cases in which the offender has some treatable addiction or condition.
Municipal Courts are divided into two categories. The first type is known as Municipal Courts “of records” that handle cases that include some misdemeanor criminal cases and most violations of traffic, parking, and environmental ordinances. The second type is known as Municipal Courts “not of record” that handle violations of municipal ordinances.
Workers’ Compensation Court of Existing Claims
The Oklahoma Workers’ Compensation Court of Existing Claims has exclusive jurisdiction to handle claims filed at the Oklahoma Workers’ Compensation Act particularly for work related injuries that occurred before February 1, 2014. These claims include any right contained in the Act, claims for compensation, and the liability of insurers and employers. Workers’ Compensation Commission is a state administrative agency that handles any claims for work-related injuries that occurred after or on February 1, 2014.
Court of Tax Review
This a specialized pane of the District Court with exclusive and limited jurisdiction over some cases that are connected to ad valorem taxation, such as appeals of the decisions made by state tax agencies.
There is an independent Tribal Court system in Oklahoma and it shares with District Courts some criminal and civil jurisdiction.
